Public access is restricted to the UBO Register as it is considered as a breach of personal data




On 22nd November 2022 the European Court of Justice has officially decided through its judgement that the provision of the Directive 2015/849 that the public access to the UBO Register is prohibited on the grounds of a breach of personal rights and violation of data privacy in accordance with Article 7 (Respect for private and family life) and Article 8 (Protection of personal data) of the EU’s Charter of Fundamental Rights.


This means that from now on and onwards any data of the Ultimate Beneficial Owner which is published on the official register cannot be accessed by individuals and being available only to the authorized people and institutions, such as lawyers, auditors and etc.
